Eric Holder is likely to be confirmed as
attorney general later today. Holder will be the first African American to hold that post. He will have to rehabilitate a department that has been criticized for injecting politics into the hiring of officials and the firing of attorneys. He will also have to take a call on whether to prosecute
Justice Department officials who have violated the law.
Holder declared unequivocally at his confirmation hearing, "Waterboarding is torture." This statement about an interrogation technique signalled a drastic change in policy. The Bush administration regarded the tatic as legal and did not consider it torture.
